FTC Accuses Shkreli of Violating Lifetime Pharma Ban on Livestream
FTC and seven states seek contempt over Shkreli's alleged lifetime pharma ban violations, with livestream remarks at issue.
Based on reporting by Beth Mole for Ars Technica. This case concerns a filing by the Federal Trade Commission.
Martin Shkreli—the ex-pharmaceutical executive infamous for illegally hiking the price of a lifesaving anti-parasitic drug by more than 4,000 percent and getting a seven-year prison sentence for the fraudulent scheme he used to do it—has been under a lifetime ban from the pharmaceutical industry since 2022.
However, according to the Federal Trade Commission and the attorneys general of seven states, Shkreli has “flagrantly and repeatedly” violated that ban nearly the entire time—allegedly by trading stock in dozens of drug companies and discussing the industry during livestreams on social media.
Editorial Opinion
In the short term, how stock mentions by streamers are treated is seen as the key issue. The balance between the lifetime ban and freedom of expression may be clarified in court. Scrutiny of pharma-related communications is assessed to intensify. The impact is seen as extending to others subject to similar orders.
In the long term, the permanence of online posts is seen as becoming an established enforcement tool. The trend of admitting livestream footage as evidence is assessed to strengthen. The effectiveness of industry bans is seen as being supplemented by technical monitoring. Companies may also review their systems for monitoring public statements.
The remaining question is assessed to be the clarity of the scope of the ban. At issue is where stock ownership and public statements cross into violation. Whether gradually stronger sanctions will deter is also seen as untested. Attention is assessed to focus on whether upcoming proceedings will set standards.
